A History of Conflict Between Neighbors

2001 -2003 • St. Martha's Church Applies to Site Plan Review Board (SPRB) to amend its site plan to include an expanded parking lot. Neighbors requested SPRB to deny request becausethe plan did not include a hundred-foot greenspace as required in the ordinance (Article 11, Sect. 8 [a and b]). The SPRB acquiesced and permitted the church to construct the parking lot within 20 feet of the property line, but did require a berm and evergreens.

Spring 2003 • SPRB voted to deny the church's request for a third curb cut, citing two driveways on Portland Road. In order to move forward with parking lot expansion, the church modified the site plan application, eliminating the cut-through to Dunroven Drive.

Fast-forward to 2009...

In the spring of 2009, frustrated with having to wait to turn left and head north on Portland Road (U.S. Route One) after mass, a few members of the St. Martha's Church council decided to revive the idea of connecting the church parking lot to Dunroven Drive and filed an amendment of its site plan with the Kennebunk Site Plan Review Board. With support of staff from the Town Planner's office, the thinking was that if church traffic could exit onto Dunroven Drive, northbound traffic could exit on the traffic signal at the intersection of Merrifield Drive and Portland Road, thereby reducing wait time in the parking lot.

July 2009 • Site Plan Review Board holds public hearing on an amended site plan submitted by St. Martha's Church for the purpose of constructing a 20' connector road between its parking lot and the cul-de-sac on Dunroven Drive. St. Martha's Church granted up to three months to conduct a traffic study, explore the synchronization of a new traffic signal installed at the junction of Post Office Square and Portland Road (activated in late June 2009), and explore the possibility of connecting the parking lot to the parking lot shared by Savings Bank of Maine and the newly-constructed CVS store. When asked, neighbors asked if they would be notified when the public hearing would be re-opened. Assistant Town Planner indicated that only abutters would be notified (by certified mail, return receipt required).

October 15, 2009 • Site Plan Review Board meets. SPRB and planning staff decide that changes proposed by St. Martha's do not constitute a major change to Site Plan and, therefore, notification of abutters was unnecessary. As a result, no representatives from the Dunroven Drive or Longview Terrace Development were in attendance. St. Martha's Church proposes to consolidate its two driveways on Portland Road to a sinngle driveway and requests the Site Plan Review Board to approve the plan which, in effect, would make the connector to Dunroven Drive the second curb cut, which, in turn, was consistent with the two-cut maximum as specified in the ordinance. Approval pending agreement with town engineer.

October 29, 2009 • Site Plan Review Board has special meeting and approves the amended plan submitted by St. Martha's Church.

November 13, 2009 • Residents of Dunroven Drive file an appeal with the Kennebunk Board of Appeals requesting a reversal of the decision of the Site Plan Review Board. Read the application for appeal.
